State reaches $2.25M settlement with EpiPen maker Mylan

New Mexico has reached a $2.25 million settlement with EpiPen maker Mylan Inc. over allegations the company used anticompetitive tactics to keep prices high for the life-saving allergy device, Attorney General Ra煤l Torrez announced Wednesday.

The settlement resolves allegations made by the New Mexico Department of Justice that the pharmaceutical company violated a series of statutes, including the state鈥檚 Antitrust Act and Fraud Against Taxpayers Act, though Mylan has denied any wrongdoing.

Under the settlement, Mylan has agreed to donate up to 10,000 EpiPens over the next four years to the state, as well as increase its co-pay coupon for the generic device from $25 to $40, which the NMDOJ says will lessen out-of-pocket costs for patients in New Mexico.

Mylan 鈥 which now goes by Viatris Inc. following a 2019 merger with Upjohn, a division of Pfizer 鈥 also agreed to work with New Mexico to 鈥渋ncrease awareness鈥 of its EpiPen4Schools Program, providing free EpiPens to schools.

鈥淭his settlement serves as an important protection for New Mexico consumers and families who depend on affordable access to life-saving epinephrine products,鈥 Torrez said in a statement. 鈥淭he New Mexico Department of Justice will continue to fight for fair pricing and transparency in the pharmaceutical industry.鈥
