Andrew Brown is remembered by his family as a 鈥渄evoted father who dreamed of becoming a barber and mentoring at-risk youth.鈥�

That life and potential came to a sudden end in broad daylight on a two-lane road west of Las Cruces when Brown, 40, was struck by a car while riding his bicycle.

Brown was crossing North Fairacres Road on June 22 when, according to police statements, a Cadillac Escalade SUV hit him at high speed. Brown lay in the roadway with severe injuries and died at the scene. Police measured 208 feet of skid marks at the crash site and estimated the vehicle鈥檚 speed at up to 69 mph. The posted speed limit on the road is 40 mph.

The accused driver, Kimberly Skaggs, 54, has been charged with leaving the scene of an accident that resulted in a death and tampering with evidence. A witness took a photo, shown during a court hearing Monday morning, that showed the car driving away, leaving the bicycle broken into pieces and Brown lying in the roadway. Skaggs, who is in custody awaiting trial, has not yet entered a plea in the case.

Over the weekend, Santana Santiago, Brown鈥檚 former partner and mother of his 14-year-old son, who both live in Arizona, filed a wrongful death lawsuit aiming to hold Skaggs liable for his death.

鈥淚 lost one of my best friends, and my son was robbed of his father,鈥� Santiago said in a written statement. 鈥淎ndrew loved our son with all his heart. Although Andrew and my son lived in different homes, distance never defined the relationship he had with our son. He regularly wrote letters offering advice and guidance about becoming a good man, called often and remained committed to being present in our son's life despite the miles between them.鈥�

The family said Brown planned to attend barber school, wrote poetry, loved rhythm-and-blues music and dreamt of using community radio to encourage youth 鈥渢o choose a different path than the one he once traveled.鈥�

The family鈥檚 attorney, James Tawney, stated that the lawsuit is seeking compensatory and punitive damages for unsafe driving, fleeing the scene without stopping to render aid as required by law, and for alleged efforts to conceal the car after the crash that have been presented in the criminal case. The suit also claims a loss of consortium, based on Brown鈥檚 son losing his relationship with his father.

鈥淜nowing he was left to die alone after the crash is something that no family should ever have to live with and we intend to fully uncover why Skaggs left the scene,鈥� Tawney stated.

Skaggs did not appear to have an attorney representing her in the civil case as of Tuesday.
