RIO RANCHO 鈥� The Rio Rancho Governing Body has approved two new projects to expand childcare options across the city.

First, the council approved a site plan for a third La Esperanza preschool/daycare facility.

District Two Councilor Jeremy Lenentine spoke in favor of the project.

鈥淚 got a full tour of their facility and worked with their staff on a couple different events,鈥� Lenentine said. 鈥淚ncredible facility, great staff, very good with the kids, well run, and you know, I think they do an excellent job. So I want to say that from the get-go, I'm excited about this project.鈥�

The plan was approved for a roughly 16,000-square-foot project just off Arena Drive near the City Center, with capacity for 84 infants/toddlers and 80 preschoolers. The site plans include 47 parking spaces and a dropoff loop from Arena Drive, a stormwater retention pond, a courtyard with an orchard, play structures and garden plots.

Next steps for the site include obtaining building permits, inspections and traffic impact reports.

The other childcare project approved was a site plan for a daycare facility on a special-use lot near the intersection of Southern Boulevard and Golf Course Road.

The approved plan now makes the use of this lot as a daycare facility concrete, in addition to the earlier zoning change that made it possible.

The unspecified applicant can now proceed to build and operate a daycare on that land in line with the approved site plan.

The governing body approved both projects unanimously.

This move comes after New Mexico became the first state in the nation to offer no-cost universal childcare.

Rio Rancho upholds narrow-lot home variances

Meanwhile, the Governing Body also upheld a Planning and Zoning ruling that allowed single-family homes to be built on two 50鈥慺oot-wide lots.

District 1 Councilor Deborah Dapson was the only one to dissent, while District 5 councilor and Deputy Mayor Karissa Culbreath was excused from the meeting.

Current zoning rules for the area, located in Rio Rancho Estates, state lots should be 60 feet wide, but P&Z approved variances allowing two homes to be built on 50鈥慺oot lots.

Rebecca Smith, a Rio Rancho resident, filed an appeal on that decision on the basis of whether the owners of the two lots had shown a legitimate hardship under the city鈥檚 variance standards.

鈥淚 am not asking the board to prevent anybody from buying or selling property 鈥� My question is what effect the city鈥檚 overlay ordinance had on these lots while they were under common ownership and whether the current applicant has actually established the hardship required for a variance,鈥� Smith said.

Under Rio Rancho's Code of Ordinances, a legitimate hardship requires a noteworthy physical condition of the property itself that prevents any reasonable use of the land. This includes, but is not limited to, an exceptionally irregular shape, narrow width, shallow depth or steep slope.

Smith argued the applicants did not meet the legal standard for a variance and that the situation was self鈥慶reated, not a true hardship.

She also claimed that the two lots were held together under the same owner from 1973 to Dec. 4, 2025, and therefore should have been treated as one larger piece of land, not split.

The lots were purchased on the same day, and both variance applications were filed on the same day and time, on May 1.

For one lot, CLI Properties is the owner, with Solano Builders as the agent. For the other lot, Solano Builders is itself the applicant, according to agenda documents.

Another Rio Rancho resident, Vera Utara, whose house is next to the lots, also spoke up against the development of the land, citing concerns over how the building will affect her property.

She framed the hardship as the builder鈥檚 choice, not an unavoidable consequence.

鈥淚t鈥檚 not a hardship for this guy because he bought both the lots to begin with 鈥� he could build on the two; he has a big, expensive, lovely custom house 鈥� so he could still make money, so he does have options,鈥� Utara said.
