Former legislative candidate and state Republican Party Treasurer Kimberly Skaggs is accused of fatally striking a bicyclist with her car and leaving the scene of a crash near Las Cruces.

Skaggs, 54, was arrested Wednesday on fourth-degree felony charges of leaving the scene of an accident that resulted in death and tampering with evidence, according to jail records. On Thursday, prosecutors requested a pretrial detention hearing in which a judge would decide whether Skaggs should remain in custody as her case proceeds.

Do帽a Ana County Sheriff鈥檚 deputies responded to a hit-and-run crash Monday afternoon in the Fairacres community just west of Las Cruces, according to charging documents. A witness told detectives she observed and photographed a woman leaving the scene in a Cadillac Escalade.

The crash victim 鈥� identified as 40-year-old Andrew Brown 鈥� was struck and severely injured while crossing the roadway by a vehicle traveling north on Fairacres Road. Brown was pronounced dead at the scene.

Investigators gathered debris from the vehicle and measured 208 feet of skid marks, according to a deputy鈥檚 affidavit. Images from police surveillance cameras as well as a business helped detectives identify the vehicle, which was subsequently linked to Skaggs and a previous traffic citation, in September, for 鈥渞acing on streets-exhibition driving.鈥�

Deputies tracked the vehicle to a property owned by Skaggs a few miles away from the crash scene and executed a search warrant for the vehicle on Tuesday. At the scene, deputies reported finding damage to the front of the vehicle, tread marks on the front bumper consistent with a bicycle tire, and a flat front tire with traces of bicycle tire sealant and blood near the wheel well, the affidavit stated.

The criminal complaint alleges the vehicle appeared to have been parked under a carport on a vacant property in an effort to hide it, as a basis for the evidence-tampering charge.

Skaggs is a former chair of the Do帽a Ana County Republican Party who has run for the state Legislature three times since 2020, when she challenged state Sen. Jeff Steinborn, D-Las Cruces. In 2022 and 2024, she ran for the state House seat represented by Democrat Nathan Small. She has also served as the state GOP鈥檚 former executive director and was until recently the state party鈥檚 treasurer. 

On Thursday, a state party official told the Journal, 鈥淜imberly Skaggs is no longer affiliated with the Republican Party of New Mexico. We will not be commenting further on this matter.鈥�

On Wednesday night, Skaggs鈥� name appeared on a list of governing board members of the Alma d鈥橝rte Charter High School in Las Cruces. By Thursday, her name had been removed and an email provided by the school indicated Skaggs resigned on June 3. 

Skaggs鈥� name and photo were also removed from the Republican Party of New Mexico webpage listing its officers sometime between 10 p.m. and 10:30 p.m. Wednesday. 

As of Thursday afternoon, Skaggs remained in custody at the Do帽a Ana County Detention Center and had retained a defense attorney. Her next court appearance did not appear to have been scheduled.
