LAS CRUCES 鈥� A Venezuelan man whose arrest last year in Las Cruces was publicized by Trump administration officials was recently sentenced to 19 months in prison and faces removal from the 近距离内射合集 States.

Cristhian Ortega Lopez was arrested in 2025, along with two roommates, at a residence where he had been staying as a guest of former Do帽a Ana County Magistrate Judge Joel Cano and his wife, Nancy Cano.

Ortega Lopez later pleaded guilty to being an illegal alien in possession of firearms based on social media posts showing him at a shooting range and evidence he had handled firearms at the residence. He was already involved in an immigration case after entering the U.S. without authorization in 2023. He also pleaded guilty to conspiracy to tamper with evidence over a deleted Facebook account following his arrest.

The Department of Homeland Security repeatedly alleged that Ortega Lopez was a suspected member of Tren de Aragua in news releases, social media posts and other commentary, although the charges did not involve those claims.

In court filings, prosecutors asserted a gang connection was indicated by Ortega Lopez鈥檚 tattoos, emojis and hand gestures used in text messages and social media posts and a photograph of a corpse that appeared to be from a news organization.

鈥淭he government failed to prove any affiliation between Cristhian and Tren de Aragua, and the Court鈥檚 recognition of that is exactly the kind of rigorous, evidence-based judgment our justice system depends on,鈥� Ortega Lopez鈥檚 attorney, Shaharazad Booth, wrote in a statement for the Journal.

After a February hearing pertaining to how Ortega Lopez would be sentenced, U.S. District Judge Margaret Strickland ruled there was not sufficient evidence linking Ortega Lopez to the gang for the purposes of determining his penalty.

At stake was the possibility Ortega Lopez could be remanded to El Salvador鈥檚 CECOT prison for terrorists and gang members instead of his home country. Booth said she was hopeful that prospect had been averted.

On June 30, Strickland sentenced him to 19 months of confinement on each count, to run concurrently, followed by a year of unsupervised release. She also instructed Immigration and Customs Enforcement to begin removal proceedings as he serves his sentence.

鈥淔rom the outset, this case bore the marks of a political vendetta out of Washington, and Cristhian was caught in the crossfire of that agenda,鈥� Booth said in a statement praising the extended efforts of the defense team. 鈥淐risthian is ready to go home to his family, and we hope this ruling will spare him from being sent to CECOT to serve a life sentence he did not deserve."

The U.S. Attorney鈥檚 Office, which prosecuted the case, did not respond to a request for comment Thursday. 

The Canos, meanwhile, are free as they await trial.

A federal grand jury indicted Nancy Cano for allegedly conspiring to tamper with evidence by deleting Ortega Lopez鈥檚 Facebook account.

Joel Cano was charged with tampering with evidence and conspiracy after allegedly destroying a mobile phone of interest to the investigation. The couple pleaded not guilty to the charges.

Recent court filings indicate the trial might occur in late September.
