AG Torrez opposes Trump’s proposed changes to radiation protection rules
The Trump administration argues that the new rules will remove red tape for a new generation of nuclear power plant proposals.
Attorney General Raúl Torrez on Tuesday made a filing with the U.S. Nuclear Regulatory Commission opposing the agency’s proposed changes to radiation exposure limits that he said “threaten to put public health and safety at risk.”
President Donald Trump on May 23, 2025 issued an executive order that directed the NRC to undertake a “review and wholesale revision of its regulations” related to radiation exposure limits for the public and employees who work around radiation. The changes, in part, are meant to clear regulatory hurdles for a new generation of advanced nuclear power reactors.
Torrez joined attorneys general in 10 states in voicing concerns about the proposed changes. The coalition’s remarks are one of more than 2,300 public comments.
“The NRC’s sweeping proposed rule changes would raise allowable radiation exposure levels, weaken monitoring and reporting requirements, and roll back a long-standing standard, which is one of the most important science-based safeguards we have to minimize radiation risks,” Torrez said in a press release on Tuesday. “Equally troubling, the NRC proposals would fast-track segments of nuclear power plant construction without environmental review or meaningful public involvement.”
The nuclear power industry has long argued that it is overregulated. One NRC proposal, published in the in July, aims to amend radiation protection standards. The agency says the new language would “address unnecessary conservatism and excessive subjectivity in regulatory requirements as they relate to protection from very low doses of radiation.”
Humans are regularly exposed to different types of radiation through natural and man-made sources, from cosmic radiation to X-ray machines to radon exposure. The annual average dose of radiation per person from all sources is roughly 620 millirems, or mrems, . The NRC has established standards that allow exposures of up to 5,000 mrems per year for those who work with and around radioactive materials, and 100 mrems per year for members of the public.
The NRC, in its proposed rule changes, argues that the average lifetime risk of dying from cancer is 20%, and that an average dose of 100 mrems per year to a person “would conservatively result in an addition of only 0.35% to that average lifetime risk.”
The NRC proposes to make it easier for NRC licensees — such as nuclear power plants — to allow for variances in the 100 mrem/year dose limit for members of the public who enter into controlled areas in or around facilities that handle radioactive material. Under the proposed changes, workers in such facilities could also receive doses in excess of annual limits under certain circumstances.
“The intent of these revisions is twofold and directed at enabling the safe use of nuclear technology while maintaining reasonable assurance of adequate protection from the health effects of radiation exposure and reflecting on several decades of experience since the last major revisions” to radiation protection standards, the NRC said in its proposal.

“If new nuclear reactors are as safe and clean as proponents claim, then existing public health protections should not need to be weakened to build them,” Brown wrote. “Expanding nuclear power, nuclear-powered data centers, or the nuclear weapons complex must not come at the expense of the people who live and work around these facilities.”
The public comment period for the rule closed Aug. 31. The NRC is expected to make a final decision on certain of the rule changes by February of next year.
