'I'm not beholden to anybody,' Bregman says

County DA rides into June 2 primary by declaring he'll govern for everybody, not just political class

The black cowboy hat isn鈥檛 a campaign prop, says Democratic gubernatorial candidate Sam Bregman. It鈥檚 part of his history.

Bregman isn鈥檛 bothered about the optics as he heads toward the June 2 primary election, facing progressive former congresswoman and Interior Secretary Deb Haaland in an uphill battle for the nomination.

鈥淲hat I am going to do is not what politicians necessarily think the next governor should be doing, but I鈥檓 going to be doing things that I think are going to move this state forward, because I鈥檓 going to have the back of every regular New Mexican out there, not the political class, if you will. 

鈥淚鈥檓 going to represent everybody, and I鈥檓 not beholden to anybody,鈥 said Bregman, who is behind in the polls and in fundraising, receiving a reported $3.7 million so far compared to Haaland鈥檚 $11.1 million campaign contributions.

Though he grew up on the East Coast, Bregman鈥檚 been riding horses since his college days at the University of New Mexico. 

鈥淚t鈥檚 where everything washes away and you realize what things are important in life,鈥 said Bregman, who since 2023 has led the state鈥檚 largest prosecutors office in a state afflicted by high violent crime rates and drug use.

Years ago, running unsuccessfully for state land commissioner, Bregman campaigned as 鈥淎 good guy in a black hat.鈥 

Since then, he鈥檚 been elected to the Albuquerque City Council, established a successful private criminal and civil law practice, and has served as 2nd Judicial District Attorney in Bernalillo County since 2023.

鈥淚 wore a cowboy hat in my first political race,鈥 he told the Journal recently, 鈥渁nd I鈥檓 obviously wearing one in my last political race.鈥

His mix of politics and the law over the past three decades of public life have fueled what he describes as his 鈥減assion鈥 to 鈥渟tand up for the Constitution and hold people accountable.鈥

鈥淚t鈥檚 fairly empowering for me to be able to give somebody a voice. Usually it鈥檚 the little guy.鈥 His campaign merchandise includes 鈥淒on鈥檛 Back Down鈥 T-shirts.

During his career, Bregman sometimes took unpopular positions, and represented unpopular people, such former state Treasurer Robert Vigil, who was convicted of one count of attempted extortion. Critics also have branded Bregman a media hound, and he鈥檚 been accused of grandstanding a time or two.

As a city councilor representing the Northeast Heights from 1995 to 1999, Bregman pushed for fines or other penalties against parents of juvenile offenders. That idea was a nonstarter.

Since becoming DA, Bregman has been vocal about the surge in violent juvenile offenders whom he believes are facing little to no consequences for their actions. His campaign to reform the state Children鈥檚 Code so far has failed to win the approval of the Democratic-led state Legislature. Bregman believes he鈥檇 have a better chance as governor.

鈥淚鈥檝e indicted 77 juveniles for murder in three years,鈥 he said. 鈥淭hink about that number, and many of them were in the criminal justice system before that and nothing was done to intervene with them. It鈥檚 not just about consequences, but about getting the help they need.鈥

His quest to convince state lawmakers to enact tougher criminal laws has had 鈥渟mall victories,鈥 he said. The Legislature, for example, increased the penalty for second-degree murder in 2024.

Bregman believes in modernizing the state Legislature, proposing term limits for state legislators and paying them a salary.

Back in his City Council days, Bregman successfully championed the implementation of a pilot program known as SANE, or the Sexual Assault Nursing Examiner program, which trains nurses to comprehensively care for victims of sexual assault.

鈥淪ince then, we've helped thousands of sexual assault victims and survivors,鈥 Bregman said.

He also introduced the first hate crime ordinance in New Mexico鈥檚 history during his time on the City Council. 

He was the only city councilor to vote in 1999 against the city building a statue that memorialized Juan de O帽ate, the controversial Spaniard who helped colonize New Mexico in 1598.

Bregman at the time said he could not support a piece of public art that "insults so many people." The city ultimately removed the statue in 2020 after protesters tried to topple it, and violence broke out.

Bregman said over the years he鈥檚 learned to temper the way in which he expresses himself.

鈥淏ut I think my passion is still there,鈥 he said. 鈥淲hether it鈥檚 in federal court or state court, no one鈥檚 ever called me a shrinking violet.鈥

Former Albuquerque Mayor Jim Baca said of Bregman, 鈥淚 never got along with him, but I always had a little bit of respect for him. Knowing Bregman, I think he will fight back against whatever gets thrown our way.鈥

Baca, who was mayor during Bregman鈥檚 term, said the candidate 鈥渉as a good handle on the issues.鈥

鈥淚 certainly don鈥檛 agree with him on some of his stands, but I think he鈥檚 the kind of fighter that this state鈥檚 going to need (in the 2028 election).鈥 

But his advice to Bregman when they recently ran into each other: lose the cowboy hat.

鈥淎nybody left of center doesn鈥檛 like that image, you know,鈥 Baca added.

State Sen. Joseph Cervantes, D-Las Cruces, praised Bregman鈥檚 work as district attorney.

鈥淚 think Sam has made some very important progress in Albuquerque,鈥 said Cervantes, who as chairman of the Senate Judiciary Committee has mostly opposed strengthening criminal laws as a way to reduce crime.

Cervantes said he believes a better tact is 鈥渉aving better effective leaders in the prosecutors roles and on the bench.鈥

As to Bregman鈥檚 style, Cervantes said he hasn鈥檛 changed much since they both went to UNM Law School, 鈥淗e鈥檚 a big personality, and big personalities are the type that get things done,鈥 Cervantes said.

The Washington, D.C., native and son of an attorney/sports promoter owns two horses and leases an East Mountain ranch. A former chair of the New Mexico Racing Commission, Bregman said, 鈥淚鈥檝e worn a cowboy hat since I was in jackpot ropings.鈥

After a short-lived baseball stint with the University of New Mexico Lobos, he became an 18-year-old Democratic precinct chairman in the East Mountain village called La Madera, where he lived with his older brother for a time.

鈥淲e started raising horses and living out our cowboy dreams of too many cowboy movies growing up.鈥 Bregman tells of being recruited by the neighbors to complain to the Sandoval County Commission about the condition of the roads.

鈥淭ell them, 鈥業f they don鈥檛 come fix the roads, we鈥檙e not going to vote for them,鈥欌 he recalled being advised.  鈥淎 week later, the county commissioner was up there. A week after that, the grader was up there, and since then, there was regular maintenance of the road.

鈥淭hat鈥檚 such a simple little thing now, but if you look back at it, it was a big momentous thing, for they listened to you. It was the fact that we actually got something done.鈥

Bregman, 62, went on to graduate from University of New Mexico Law School, married his wife Jackie, and had a family, including Alex Bregman, a third baseman with the Chicago Cubs, and moved back into Albuquerque from the East Mountains. He owned the now-defunct Albuquerque Thunderbirds NBA Development League team.

He鈥檚 appeared at high school gymnasiums to talk about gun violence, and has helped shut down multiple massage parlors and break up human trafficking organizations as chairman of the Governor鈥檚 Organized Crime Commission.

Albuquerque attorney Martin Esquivel told the Journal that in building consensus with various groups, 鈥渋t鈥檚 uncanny 鈥 when you watch him; he can really connect with just about everyone.鈥

鈥淗e doesn鈥檛 come across as scripted,鈥 added Esquivel, who said he is a close friend of Bregman鈥檚.

Bregman, a former deputy state auditor, said he had planned to retire before his appointment to DA by Gov. Michelle Lujan Grisham, and was later elected to the four-year position in November 2024.

A decade earlier Bregman and five other Democrats were sued after emails from the campaign website of then-governor Susanna Martinez were hijacked by her former Republican campaign manager. Bregman headed a Democratic political action committee, and had a stint as the state Democratic Party chair.

Bregman denied any wrongoing before the civil lawsuit was dismissed in 2016. He declined to answer Journal questions about the case, citing a non-disclosure agreement.

While running behind Haaland in the polls, Bregman said recently, 鈥淚 welcome being the underdog, because I know that New Mexico in many ways and, certainly New Mexicans, are underdogs and we have a lot to accomplish. And being involved in sports and just living my life of 62 years, I know that, a lot of the time underdogs win.鈥
