OPINION: Bernalillo County property owners deserve fairness, not confusion

I am running for Bernalillo County assessor because property owners deserve fairness, transparency and dependable service. That is what people should expect from this office every day. It is also why I believe short-term rental properties should remain classified as residential unless and until the Legislature clearly says otherwise.

I worked in the mortgage industry for 33-plus years along with being a Realtor for six years. Additionally, as a former Bernalillo County clerk, I have worked around government long enough to know that when the law is unsettled, public officials should be careful. They should not rush ahead of the Legislature. They should not create confusion for taxpayers. And they should not force homeowners into a dispute that the state itself is still trying to sort out. My work was based on specific statutory guidelines. All three positions 鈥 county clerk, mortgage lender and Realtor 鈥 had statewide rules and regulations to guarantee uniformity.

That is exactly what happened with short-term rentals.

House Memorial 52 called for a statewide group to study the economic impact, taxation and regulation of short-term rentals in New Mexico. It also asked county assessors to pause further reclassification until that work was done. That was a reasonable request.

That is how government should work. If there is going to be change, it should be clear, it should be statewide, and it should be applied fairly to everyone.

Instead, Bernalillo County Assessor Damian Lara moved ahead with a disputed interpretation that created confusion and unequal treatment. Most counties did not take the same approach. Homeowners were not treated fairly across the state. It caused confusion and it wasn't fair.

When the treasurer realized the problem, he started correcting the reclassification of certain short-term rentals. The assessor blocked the treasurer鈥檚 access to the computer program that they both use to do their jobs. It took action by the county manager to agree with the treasurer to get the treasurer鈥檚 access back.

This is not the assessor鈥檚 first improper behavior affecting property owners. He blatantly gave misleading information to folks regarding putting their properties in or out of revocable 鈥渓iving trusts.鈥 The assessor reassessed their properties and removed their 3% caps. This caused a class-action suit in which a judge ordered the assessor to reverse his actions and apologize to the property owners for blatantly giving them misleading and inaccurate information.

On top of all that, he is using your tax dollars to run for reelection. He is running expensive ads in the 近距离内射合集 every week prominently displaying a professional photograph with his name highlighted prominently twice with information concerning the assessor鈥檚 office. County ethics; Section 2-130 (a) (1) states: 鈥淓lected officials, employees, and volunteers shall treat their position as a public trust, with a fiduciary duty to use the powers and resources of public office only to advance the public interest and not to obtain personal benefits or pursue private interests.鈥 In my opinion this represents a serious breach of public trust.

I feel Bernalillo County property owners need an assessor who understands that fairness matters, and public trust matters. I contend the assessor should serve the public with clarity, restraint and common sense. That is the kind of assessor I intend to be.
